Deep Dive Learning Academy – Terms Of Service

Please read these Terms of Service (collectively with Deep Dive Learning Academy Inc.’s Privacy Policy, the “Terms of Service”) fully and carefully before using www.DeepDiveEducation.com (the “Site”) and/or any of the other services, features, content or applications offered by Deep Dive Learning Academy, Inc. (“we”, “us” or “our”) (together with the Site, the “Services”). These Terms of Service set forth the legally binding terms and conditions for your use of the Site and the Services.

Acceptance of Terms of Service

  1. By registering for and/or using the Services in any manner, including but not limited to visiting or browsing the Site, you agree to these Terms of Service and all other operating rules, policies and procedures that may be published from time to time on the Site or any of the Services by us, each of which is incorporated by reference and each of which may be updated from time to time without notice to you.
  2. Certain of the Services may be subject to additional terms and conditions specified by us from time to time; your use of such Services is subject to those additional terms and conditions, which are incorporated into these Terms of Service by this reference.
  3. These Terms of Service apply to all users of the Services, including, without limitation, users who are simply visiting or browsing the Site and users who are contributors of content, information, and other materials or services, registered or otherwise.

Programs

All the terms mentioned are valid for all programs, including but not limited to Full Stack Upskill (Part-time and Full-Time), Full Stack Flex (Part-time and Full-Time), Full Stack Pro (Part-time and Full-time), Full Stack Intensive (Part-time and Full-time)

Duration of the programs

The typical duration can be 22-Weeks for part-time and 14-weeks for full-time, but it can be customized according to the student’s requirements. Additional weeks are required for programs that include job assistance and a job guarantee.

Method of Payment:

Certain of our services may be subject to payments now or in the future (the “Paid Services”).Please note that any payment terms presented to you in the process of using or signing up for a paid service are deemed part of this agreement. You agree to the terms and conditions of any third-party financial institution when you choose a method of payment with us.

The terms of your payment will be based on your payment method and may be determined by agreements between you and the financial institution, credit card issuer, or other provider of your chosen payment method. If we, through the Payment Processor, do not receive payment from you, you agree to pay all amounts due on your Billing Account upon demand.

We currently have 3 options for payment :- 

1) Zero interest installments 

2) Pay in full 

3) Easy monthly installments (TIP plan) 

4) Pay after you get a job (CPP or ISA plan)

Class Rules

Preliminary work must be completed by 8:00 a.m. the day prior to the class start date. In some cases, DEEP DIVE LEARNING ACADEMY may ask students to complete the material sooner. Exceptions may be made with explicit consent from a DEEP DIVE LEARNING ACADEMY instructor or staff member.

Attendance

Attendance is required. Attendance is monitored closely during video. Attendance is critical to success in the program.

Students can miss no more than eight hours per month, and if they do, they must talk to a member of the DEEP DIVE LEARNING ACADEMY Student Success team. Missing more than eight hours per month may result in deferment to a later class or removal from the program, as determined on a case-by-case basis.

Certification

During the course, students will have several projects. Through projects, DEEP DIVE LEARNING ACADEMY can see how well a student is doing with the course material, find practice areas, and give each student individual help.

Graduation from the program requires the successful completion of all projects. If DEEP DIVE LEARNING ACADEMY sees that a student is falling behind, a member of the team will reach out to the student to talk about the best way to move forward.

Code of Conduct

DEEP DIVE LEARNING ACADEMY’s Full Stack Bootcamp is challenging by design. To ensure student success, we have outlined several guiding principles to follow.

Punctuality – DEEP DIVE LEARNING ACADEMY expects all students to be on-time for all scheduled classes, office hours, Projects, Mock interviews, and other time-sensitive obligations. Punctuality and respect for others time is a given for the roles we train for.

Participate – DEEP DIVE LEARNING ACADEMY expects each student to actively participate in the course by attending all lectures, having an online presence during course hours, engaging with instructors and Coaches, and collaborating with other students. Participating is the biggest indicator of success.

Complete All Coursework – DEEP DIVE LEARNING ACADEMY expects students to complete all assignments given as part of the course. Repetition is key to solidifying the foundation of knowledge. 

Ask for Help – DEEP DIVE LEARNING ACADEMY encourages students to proactively reach out to instructors, coaches, or fellow students for help.

Integrity – DEEP DIVE LEARNING ACADEMY has a zero-tolerance policy for plagiarism, or cheating of any kind.

Respect – DEEP DIVE LEARNING ACADEMY students and staff have diverse backgrounds. Students are expected to contribute to creating a positive experience for everyone by being respectful, tolerant, and open-minded. DEEP DIVE LEARNING ACADEMY wants to create a welcoming learning environment through encouragement, support, and active listening.

Professionalism – DEEP DIVE LEARNING ACADEMY is a professional environment. Punctuality, timeliness, accountability, and open communication are crucial, not only for student success at DEEP DIVE LEARNING ACADEMY, but also in careers afterward. Additionally, professionalism includes protecting internal intellectual property.

Mentor Sessions Usage – All personal mentor sessions must be used within 35 weeks from the date of the first personal mentor session. Any modifications to the usage of mentor sessions are implemented on a case-by-case basis.

Inactive Accounts – If there is no action for 3 months, you may lose access to the curriculum. To log in again, the student may need to contact our support team.

No Harassment Policy – DEEP DIVE LEARNING ACADEMY is a place to learn. We aim to create an environment of mutual trust and the absence of intimidation, oppression, and exploitation. Students and staff should be able to work and learn in a safe, yet stimulating atmosphere. As such, DEEP DIVE LEARNING ACADEMY will not tolerate any form of harassment, whether verbal or physical, designed to threaten or intimidate others, which includes by is not limited to the following: Verbal harassment includes comments that are offensive or unwelcome regarding a person’s nationality, origin, race, color, religion, gender, sexual orientation, age, body, disability or appearance, including epithets, slurs and negative stereotyping. Nonverbal harassment includes distribution, display or discussion of any written or graphic material that ridicules, denigrates, insults, belittles or shows hostility, aversion or disrespect toward an individual or group because of national origin, race, color, religion, age, gender, sexual orientation, pregnancy, appearance, disability, sexual identity, marital or other protected status.

Violations of the Code of Conduct may result in deferral or removal from the program. If removed from the program for Code of Conduct reasons, students’ Income Share Agreement or tuition refund will be prorated as described in the Payment, Withdrawal, and Refund Policy below.

Ground Rules for Students

  1. You will notify us if you need to take a break from classes for any reason. Given that the break is only a few weeks, we will most likely accept it, and you will resume your studies on the stated date.
  2. After you finish each module, you will sign up for mock interviews. This is a good way to make sure you can pass technical interviews without a whiteboard. (Coder Foundry advocates for having a strong portfolio and asking the employer to look at their projects in order to keep the interview about things they know.   This allows the interviewee to show they really can code instead of failing because they don’t know some software development term)
  3. By working on the material between meetings, you can keep the program moving forward. If you miss too many meetings because you can’t find time to study, we will discuss whether your progress is acceptable. For instance, if your current progress doesn’t let you graduate within a year, we will consider your progress unacceptable and will discuss ways to help you find the time to complete the program or whether you still want to continue the program.
  4. You will be respectful of your mentor and any other staff you meet at DEEP DIVE LEARNING ACADEMY. A good rapport should be established to make the experience enjoyable for all parties. You can ask for a different mentor if you want to, but we recommend that you do so at the start of your program.
  5. All personal mentor sessions must be used within 30 weeks from the date of the first personal mentor session. 
  6. If there is no activity for 3 months, you may lose access to the curriculum. To log in again, the student may need to contact our support team.

Compliance

If a student stops paying while enrolled, we have the right to remove the student from the course.  If payments extend beyond the course length and the student stops paying after completing the course, we have the option to send the contract to collections.

Payment, Withdrawal, and Refund Policy

1) Zero Interest Installments

Zero interest installments allow students to pay back a fixed amount each month for six months after their enrollment. The number of months can vary from case to case, but in any case, this payment method does not involve any additional interest beyond the total fees.

3) Pay After You Get A Job or Contingent Payment Plan (CPP) Contract Terms

A CPP allows students to pay back a fixed amount each month after their program ends. Payments are only made when the student is employed and earns above a minimum income threshold. Payments keep coming for a set number of months or until a maximum amount has been reached. Students will make a fixed monthly payment once they have graduated and have a job that earns at least $45,000 or more.

Plan Term – refers to the period during which the student has a contingent obligation to make qualified monthly payments, as provided under the agreement (e.g. 48 qualified income-earning months where the student has earned above the minimum monthly income threshold)

    1. Payment term will begin only after a student
      1. has completed, withdrew, or otherwise separated from the program, whichever occurs first AND their official completion date has been reported by the school on the LEIF platform
      2. has completed any contractually defined grace period (school partners should review their specific agreements to confirm if this applies)
      3. has income greater than or equal to the minimum monthly income threshold
    2. As per the CPP contract, students agree to accurately update and maintain employment and salary information. The contract outlines that keeping accurate records is a very important obligation. Failure to do so will put the student in breach of contract
  1. Deferment Term – Payments are paused (deferred) while the student is unable to work or is earning below the minimum monthly income threshold. If they reach the maximum deferral period, no additional payments are expected. Even if the student has not qualified for a single payment, the contract will not be extended beyond the maximum deferral period.
  2. Repayment Qualification – When a student’s gross monthly earned income meets or exceeds the minimum monthly income threshold, they are eligible for a payment.

4) Tuition Installment Plan (TIP) and Extended Installment Plan (eTIP) Contract Terms (Credit Loan Installments)

A TIP allows students to defer upfront tuition and spread payments into fixed installments. Students can start learning without having to pay for the whole course at once. Instead, they can pay for it over a set number of months. The available options are 12/24 months. You can always check here for the most up-to-date payments or your LEIF application form.

Please Note:- There may be a few discounts/scholarships provided to students during enrollment, so the price may reflect on the application page on LEIF.

  • In-Program Payment Default Grace Period – the timing the school will allow for late payments (if any). There will be an automatic 10 day period for processing, but additional time may be added at schools discretion. Students with missed payments after this period will be removed from program

5) Enrollment Fee 

The enrollment fee is applicable for certain payment options and is determined by the payment method chosen. Enrollment fee is non-refundable; however, Deep Dive Learning Academy reserves the sole right to make exceptions.

Compliance

If a student stops paying while enrolled, we have the right to remove the student from the course.  If payments extend beyond the course length and the student stops paying after completing the course, we have the option to send the contract to collections.

Refund Policy

Full and partial refunds upon cancellation or withdrawal may be given only in the limited circumstances outlined in our job guarantee policies applicable to a student’s program. When a student cancels or drops out of a program, we can only give full or partial refunds in the limited situations outlined in our job guarantee policies for that program. Other than stated in our Refund Policy, DEEP DIVE LEARNING ACADEMY does not guarantee refunds on any fees or charges related to our programs, including, without limitation, for lack of usage or dissatisfaction.

All final refund amounts will be calculated by DEEP DIVE LEARNING ACADEMY administrators, based on any special discounts given and on a case-by-case basis. DEEP DIVE LEARNING ACADEMY owns the final decision regarding the refund amounts and has all the rights associated with it.

No Refund will be issued for Seat Booking 

Module 1 : Web Development

If you withdraw within the first week of your enrollment, you may be able to get a 100% refund of your tuition fees.

If you withdraw from any program (Flex, Pro, or Intensive) after one week of enrollment, you MAY NOT receive a tuition refund. We will work with you and make all possible efforts within our capacity to find a solution for you. This will be done on a case-by-case basis.

Module 2: React & NodeJS

If you withdraw from any program (Flex, Pro, or Intensive) after one week of enrollment, you MAY NOT receive a tuition refund. We will work with you and make all possible efforts within our capacity to find a solution for you. This will be done on a case-by-case basis.

Job Assistance (Around 6 Weeks)

If you withdraw from any program (Flex, Pro, or Intensive) after one week of enrollment, you MAY NOT receive a tuition refund. We will work with you and make all possible efforts within our capacity to find a solution for you. This will be done on a case-by-case basis.

If you used the Tuition Installment Plan (TIP), Contingent Payment Plan (CPP), Income Share Agreement (Easy Monthly Installments or Pay After You Get A Job option) for your course during your enrollment, the refund amount will be deducted from what you owe to DEEP DIVE LEARNING ACADEMY. Some additional rules or calculations may apply while deciding the final amounts depending upon the third party ISA lender such as LEIF or any other provider.

Payment Policy (Third Party)

All charges on the Site are facilitated through Stripe, a third-party payment processing service. In order to make a purchase on the Site, Users are subject to, and must expressly consent to, the Stripe Connected Account Agreement, including any modifications, which includes Stripe’s Stripe Terms of Service. As a condition of DEEP DIVE LEARNING ACADEMY enabling payment processing services through Stripe, you agree to provide DEEP DIVE LEARNING ACADEMY accurate and complete information about you and your business (if applicable), and you authorize DEEP DIVE LEARNING ACADEMY to share it and transaction information related to your use of the payment processing services provided by Stripe.

Although placement assistance services may be provided, the school cannot guarantee a job to any student or graduate. DEEP DIVE LEARNING ACADEMY reserves the right to require students to share their offer letters for accepted jobs to seamlessly verify their income.

Registration

To use certain Services, you must register for an account with us (an “Account”). You must provide accurate and complete information and keep your Account information updated. You shall not: (i) select or use as a username a name of another person with the intent to impersonate that person; (ii) use as a username a name subject to any rights of a person other than you without appropriate authorization; or (iii) use, as a username, a name that is otherwise offensive, vulgar or obscene. You are solely responsible for the activity that occurs on your Account, and for keeping your Account password secure. You may never use another person’s Account or registration information for the Services without permission. You must notify us immediately of any change in your eligibility to use the Services (including any changes to or revocation of any licenses from state authorities), breach of security or unauthorized use of your Account. You should never publish, distribute or post login information for your Account. You shall have the ability to delete your Account, either directly or through a request made to one of our employees or affiliates.

Definition For purposes of these Terms of Service, the term “Content” includes, without limitation, information, data, text, photographs, videos, audio clips, written posts and comments, software, scripts, graphics, and interactive features generated, provided, or otherwise made accessible on or through the Services. For the purposes of this Agreement, “Content” also includes all User Content (as defined below).User Content All Content added, created, uploaded, submitted, distributed, or posted to the Services by users (collectively “User Content”), whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such User Content. You represent that all User Content provided by you is accurate, complete, up-to-date, and in compliance with all applicable laws, rules and regulations. You acknowledge that all Content, including User Content, accessed by you using the Services is at your own risk and you will be solely responsible for any damage or loss to you or any other party resulting therefrom. We do not guarantee that any Content you access on or through the Services is or will continue to be accurate. Notices and Restrictions The Services may contain Content specifically provided by us, our partners or our users and such Content is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. Use License Subject to these Terms of Service, we grant each user of the Services a worldwide, non-exclusive, sub-licensable and non-transferable license to use (i.e., to download and display locally) Content solely for purposes of using the Services. Use, reproduction, modification, distribution or storage of any Content for other than purposes of using the Services is expressly prohibited without prior written permission from us. You shall not sell, license, rent, or otherwise use or exploit any Content for commercial use or in any way that violates any third party right. License Grant By submitting User Content through the Services, you hereby grant us a worldwide, non-exclusive, perpetual, royalty-free, fully paid, sub-licensable and transferable license to use, edit, modify, truncate, aggregate, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the User Content or any derivative works thereof in connection with the Site, the Services and our (and our successors’ and assigns’) businesses, including without limitation for promoting and redistributing part or all of the Site or the Services in any media formats and through any media channels (including, without limitation, third party websites and feeds), and including after your termination of your Account or the Services. You also hereby grant each user of the Site and/or the Services a non-exclusive, perpetual license to access your User Content through the Site and/or the Services, and to use, edit, modify, reproduce, distribute, prepare derivative works of, display and perform such User Content, including after your termination of your Account or the Services, to the extent permitted by the Site and/or the Services. For clarity, the foregoing license grants to us and our users does not affect your other ownership or license rights in your User Content, including the right to grant additional licenses to your User Content, unless otherwise agreed in writing. You represent and warrant that you have all rights to grant such licenses to us without infringement or violation of any third party rights, including without limitation, any privacy rights, publicity rights, copyrights, trademarks, contract rights, or any other intellectual property or proprietary rights. Availability of Content. We do not guarantee that any Content will be made available on the Site or through the Services.
